Effective Date: September

Special Orders allow customers to request products that are customised or produced specifically according to their requirements.

Special Orders may involve customised materials, colours, dimensions, finishes or other design requirements and therefore require additional planning and production time.

These Terms & Conditions apply to Special Orders placed directly with AfroLamps.

1. What Is a Special Order?

A Special Order is a product that is customised or produced specifically according to a customer’s requirements and is not offered as a standard product on the AfroLamps website.Special Orders may include:

– Custom fabrics or patterns;
– Alternative colours or finishes;
– Custom lamp base designs;
– Made-to-measure dimensions;
– Special height or proportion requirements;
– Corporate or hospitality requirements;
– Corporate branding;
– Personalised gifting; or
– Other agreed design modifications.

AfroLamps will confirm whether a particular request can be accommodated before production begins.

2. Design Consultation & Approval

Depending on the nature of the Special Order, AfroLamps may provide:

– A written design description;
– A digital mock-up;
– Reference images;
– Material or fabric options; or
– Other design information.

Where a design approval is required, production will only begin once the customer has approved the final design in writing, such as by email or through an approved order form.

Once the design has been approved and production has started, changes may result in additional costs and/or delays.

AfroLamps will advise the customer of any additional costs before proceeding with material changes where reasonably possible.

3. Materials & Customer-Supplied Designs

Where AfroLamps supplies the materials, available materials will be discussed and agreed with the customer before production.Where a customer supplies:

– Fabrics;
– Artwork;
– Patterns;
– Photographs;
– Logos;
– Text;
– Branding; or
– Other intellectual property,

the customer confirms that they have the necessary rights or permission to provide the material to AfroLamps for the requested purpose.

The customer is responsible for any claims arising from the unauthorised use of material supplied by them.

AfroLamps may decline to use material where there are reasonable concerns regarding intellectual property, legality, suitability or production requirements.

4. Payment

Payment requirements will be confirmed in the Special Order quotation or order agreement.

Where a deposit is required, production will generally only begin once the required deposit has been received.

The remaining balance must be paid before dispatch or collection unless different payment arrangements have been agreed in writing.

For larger, corporate or international orders, AfroLamps may require different payment arrangements, including full payment before production begins.

Any deposit or cancellation terms will be communicated to the customer before the Special Order is confirmed.

5. Production & Lead Time

Special Orders require additional production time because materials, dimensions and designs may need to be prepared specifically for the customer.

The expected production period will be communicated in the quotation or order confirmation.

As a general indication, Special Orders may require approximately 2–4 weeks from final design approval and receipt of the required payment or deposit.

Actual production time may vary depending on:

– Design complexity;
– Material availability;
– Quantity ordered;
– Custom dimensions;
– Availability of components;
– Customer approval times; and
– Other production requirements.

If an unexpected delay occurs, AfroLamps will communicate the delay to the customer as soon as reasonably possible.

6. Changes & Cancellation

Customers should carefully review the final design before approving production.

Once production has started, cancellation or significant design changes may result in costs for materials, labour or production already undertaken.

Where a customer requests cancellation after production has commenced, AfroLamps will assess the request and any applicable refund or cancellation charge in accordance with the agreed order terms and applicable consumer protection law.

If AfroLamps is unable to fulfil a confirmed Special Order, we will communicate the situation to the customer and provide the applicable resolution.

7. Special Order Returns

Because Special Orders may be produced specifically according to a customer’s requirements, change-of-mind returns may not be available for products that have been custom-made to the customer’s specifications, subject to applicable consumer protection law.

This does not affect the customer’s rights where a Special Order:

– Is defective;
– Is unsafe;
– Is materially different from the approved design;
– Does not correspond with the agreed specifications; or
– Otherwise qualifies for a remedy under applicable law.

Please refer to the Returns & Refunds Policy and Warranty Policy for further information.

8. Delivery

Delivery arrangements and costs will be confirmed before the Special Order is finalised.

The customer will be informed of the expected delivery arrangements once production has been completed.

International customers may be responsible for applicable customs duties, taxes, import charges and clearance fees imposed by the destination country.

Delivery time may be affected by courier networks, customs processing and other circumstances outside AfroLamps’ control.

AfroLamps uses natural wood and individually produced components.Special Orders may therefore contain natural variations in:

– Wood grain;
– Colour;
– Tone;

These characteristics are part of working with natural materials and should not automatically be considered defects.

Where a particular colour, fabric, pattern or material is agreed as part of the Special Order, AfroLamps will make reasonable efforts to meet the approved specification.

10. Warranty

Special Orders are covered by the AfroLamps 6-month Warranty Policy for qualifying defects in materials and workmanship under normal intended use.

The warranty does not cover damage resulting from:

– Misuse;
– Accidental damage;
– Unauthorised modification or repair;

Unless otherwise agreed in writing, AfroLamps retains ownership of its original designs, design concepts, drawings, product designs, photographs and other intellectual property developed by AfroLamps.

AfroLamps may photograph completed Special Orders for its portfolio, website, social media or marketing purposes unless a written confidentiality or exclusivity agreement has been agreed with the customer.

Where a customer requires an exclusive design or wishes to restrict AfroLamps from reproducing or displaying a design, this must be agreed in writing before production begins.

12. Agreement

By approving a Special Order quotation or design and making the required payment, the customer confirms that they have reviewed and accepted these Special Order Terms & Conditions together with the applicable quotation, order confirmation and AfroLamps policies.

Where there is a conflict between these Terms & Conditions and a mandatory requirement of applicable law, the applicable law will prevail.
